ORDER : The Court Made the following order :- The petitioners, who was arrested and remanded to judicial custody from 08.07.2021 for the alleged offences punishable under Sections 302 of IPC, in Crime No.572 of 2021, on the file of the respondent police, seek anticipatory bail.

2. The case of the prosecution is that the wife of the deceased said to have illegal intimacy with the petitioner and the same was questioned by the deceased. Due to which the petitioner and the wife of the deceased murdered the deceased. Based on the complaint given by the brother of the deceased, the law enforcing agency registered a case against the petitioner.

3. The learned counsel for the petitioner submits that the petitioner has not committed any offence as alleged by the prosecution and he has been in judicial custody from 08.07.2021. Hence he prays for grant of bail to the petitioner.

4. The learned Government Advocate(crl side) appearing for the petitioner submit that the petitioner and the wife of the deceased murdered the deceased. He further submits that the investigation is pending and the earlier bail petition filed by the petitioner was dismissed as withdrawn in Crl.O.P.No.15133 of 2021 dated 25.08.2021. Hence, he vehemently opposed for grant of bail to the petitioner.

5. Considering the grave nature of offence committed by the petitioner, this Court is not inclined to grant bail to the petitioner.
