Seeking to condone the delay of 123 days in representing the Second Appeal against the decree and judgment of the learned Additional Subordinate Judge, Vridhachalam made in A.S.No.16 of 2010 dated 13.02.2013, the petitioner has come up before this Court with this petition.

I have heard the learned Counsel for the petitioner and I have also perused the records carefully.

I am also satisfied with the reasons stated in the affidavit filed in support of the petition. The delay is meagre. Further, I am of the view that on a technical ground of delay, the valuable right of contest of the parties cannot be deprived of. 4.

Having regard to all the above, the delay is condoned and the petition is allowed.
