Petition filed under Article 226 of the Constitution of India to issue a Writ of Certiorarified Mandamus to call for the records of the first respondent passed in the Award made in C.P.No.202 of 2011 dated 28.11.2013 and quash the same and consequently direct the second respondent management to pay a sum of Rs.13,43,551/- (Rupees Thirteen Lakhs Forty Three Thousand Five Hundred and Fifty One Only) with interest towards the balance wages and other connected benefits.

O R D E R

The petitioner has filed this writ petition seeking issuance of Writ of Certiorarified Mandamus to call for the records of the first respondent passed in the Award made in C.P.No.202 of 2011 dated 28.11.2013 and quash the same and consequently direct the second respondent Management to pay a sum of Rs.13,43,551/- with interest towards the balance wages and other connected benefits. 2.The learned counsel appearing for the petitioner submitted that the petitioner filed computation petition under Section 33-C(2) of the Industrial Disputes Act, before the Labour Court seeking to compute the amount due to him at Rs.13,43,551/- and to direct the second respondent to pay the said amount with interest, however, the Labour Court directed the second respondent to pay a sum of Rs.7,556/-, being the salary for the months of March and April, 2003 to the petitioner and aggrieved by the same, the petitioner has filed this writ petition.

3.The learned counsel appearing for the second respondent submitted that since the petitioner is now aged more than 76 years 2/4

and since he is waiting for the amount right from the year 2011, the second respondent is now ready to pay a sum of Rs.2 Lakhs to the petitioner as one time settlement.

4.The learned counsel appearing for the petitioner, on instructions, submitted that the petitioner is ready to receive the amount offered by the second respondent.

5.In view of the above, this Court directs the second respondent to pay a sum of Rs.2 Lakhs in full quit to the petitioner by way of demand draft drawn in the name of the petitioner, within a period of four weeks from the date of receipt of a copy of this order. 6.The writ petition is disposed of.
