O R D E R

The prayer sought for in this writ petition is for a writ of Certiorarified Mandamus calling for the records relating to the order of the respondent in Proceedings No.4564/C/DTRY/03, dated 10.09.2003 and quash the same and consequently, direct the respondent to issue a Caste Certificate to the petitioner as belonging to OBC.

2. When the case was called on 13.12.2017, learned counsel for the petitioner submits that he wanted to get instructions as to the current position of the issue raised in this writ petition and hence, he wanted the case to be heard after some time. Accordingly, the matter was posted today. 3.When the case is called today, Mr.Karthik Rajan, learned counsel for the petitioner submits that he has written a letter to the petitioner to get instructions as to the current position of the issue raised in this writ petition, to proceed further for adjudication. Though the said letter had been sent through Registered Post, the postal track record discloses that the item was attempted to be delivered however, the addressee moved from https://hcservices.ecourts.gov.in/hcservices/

the address. Therefore, the learned counsel for the petitioner submits that as of now, there is no instructions from the petitioner.

Since the very impugned order passed in this writ petition itself is the refusal of grant of community certificate to the petitioner for education and other purposes, due to efflux of time, since the impugned order was passed some time in the year 2004 and also the fact that petitioner has moved from the address which has been given before this Court through the learned counsel for the petitioner, this court feels that the issue raised in the writ petition does not currently survive for further adjudication.

5. In view of the same, this writ petition is dismissed. No costs.
