This Arbitration Original Petition has been filed under Section 11(6) of the Arbitration and Conciliation Act, 1996 to appoint an

Arbitrator from the panel as the sole arbitrator to resolve the dispute in accordance with the terms of the Construction Agreement dated 26.06.2021.

The learned counsel appearing for the petitioner relying the Construction Agreement dated 26.06.2021would submit that the dispute between the parties could be resolved only through arbitration in view of the said agreement.

In spite of the notice served on the respondents, which had been substantiated by production of the acknowledgment card, which indicates that the respondent had received the notice, this Court also directed the Registry to verify as to whether any vakalat has been filed by the respondent. Registry has put up a note indicating that no vakalat has been filed on behalf of the respondent.

In such circumstances, this Court appoints Mr. S.Parthasarathy, Learned Senior Advocate, having office at No.161, V.M.Street, Royapettah, Chennai - 600014 as Sole Arbitrator to enter upon the

dispute between the petitioner and the respondent. 5.

The learned Sole Arbitrator is entitled to fix his fees as per the Schedule-IV to the Act. This Court further requests the learned Sole Arbitrator to endeavour to decide the dispute as expeditiously as possible.
