2/4 Writ Petition under Article 226 of the Constitution of India, praying for issuance of a writ of mandamus directing the respondents 1 to 4 to remove the encroachments in canal situate in S.No.1/2, Mankuppai, Saminaikkanpatti Village, Omalur Taluk, Salem District, based on the petitioner's representation, dated 21.04.2022. For Petitioner : Mr.S.P.Yuvaraj For Respondents 1 to 4 : Mr.A.Selvendran, Special Government Pleader.

ORDER

(By D.Krishnakumar,J.) This Writ Petition has been filed for a direction to the respondents 1 to 4 to remove the encroachments in canal situate in S.No.1/2, Mankuppai, Saminaikkanpatti Village, Omalur Taluk, Salem District.

2. The petitioner, who is owning land in Saminaikkanpatti Village, and other villagers will get natural water from western ghats to their lands during rainy season. While so, the respondents 5 and 6 have encroached the land in Survey No.1/2 in which there is a canal, thereby obstructing the free flow of water to the lands in Saminaikkanpatti Village. Therefore, the petitioner has filed this Writ Petition for removal of the said encroachment.

3. The official respondents have filed a status report, dated 24.08.2022,

3/4 along with photographs to show that the aforesaid encroachment in Survey No.1/2 to an extent of 1.66.0 Hectares at Saminaikkanpatti Village, Omalur Taluk, Salem District, has been removed by the authorities on 20.08.2022 and, therefore, the prayer sought for by the petitioner has now become infructuous..

4. Recording the above statement of the respondents, this Writ Petition is disposed of. No costs.
