ORDER

This petition has been filed to direct the respondent to give adequate protection to the petitioner and his labourers to clean up and construct compound wall in their house plot situated at Door No.68, New Theradi Street, Ponneri Taluk, comprised in Survey No.458/31 admeasuring 2 cents and Survey No.458/4A admeasuring 3 cents and Survey No.458/11B admeasuring 1/2 cent, totalling 5-1/2 cents in accordance with law.

2. Heard the learned counsel for the petitioner and the learned Additional Public Prosecutor appearing for the State.

3. It is the case of the petitioner that he has purchased the property in question in public auction conducted by the Debts Recovery Tribunal, and that when he was proceeding to construct a compound wall, the erstwhile owners are preventing and causing disturbance. Hence, the petitioner has given a complaint dated 22.08.2016 and is seeking police protection. https://hcservices.ecourts.gov.in/hcservices/

4. Learned Additional Public Prosecutor submitted that on the complaint given by the petitioner, a petition enquiry is pending in CSR No.305 of 2016 and on the complaint given by the opposite party, a petition enquiry is pending in CSR No.293 of 2016.

5. Under such circumstances, the respondent police is directed to call both the parties and conduct enquiry in CSR Nos.305 of 2016 and 293 of 2016 and ensure that no law and order problem takes place.
