ORDER : The Court Made the following order :- The petitioner, who was arrested and remanded to judicial custody on 04.08.2021 for the alleged offences punishable under Sections Man Missing altered into Sections 147,148, 201 and 302 of I.P.C r/w Section 27(1) of Arms Act in Crime No.468 of 2021, on the file of the respondent police, seek bail.
2. 'Totally there are 2 accused in this case and the petitioner herein arrayed as A7. The case of the prosecution is that due to previous enmity the petitioner along with other accused murdered the deceased and thrown the body in the river. Hence the present petition.
3. The learned counsel for the petitioner submitted that the petitioner is an innocent person and he has been falsely implicated in this case. Hence, he prays for grant of bail to the petitioner. https://hcservices.ecourts.gov.in/hcservices/
4.The learned Government Advocate (Crl.Side) would submit that the petitioner along with other accused murdered the deceased. He further submits that the role of the petitioner in the said crime is very vital, his custodial interrogation is very much necessary to the case. Hence, he vehemently opposed for grant of bail to the petitioner.
5.Considering the gravity of offence committed by the petitioner and the submissions made by the learned Government Advocate, this Court is not inclined to grant bail to the petitioner. 6.Accordingly, this Criminal Original Petition is dismissed. -sd/- 13/09/2021 This order, on being produced, be punctually observed and carried into execution by all concerned TRUE COPY Sub-Assistant Registrar (Statistics/C.S.)
