Respondents PRAYER: Criminal Original Petition filed under Section 482 of the Code of Criminal Procedure, to direct the 3rd respondent not to harass the petitioners and their family members based on the complaint lodged by Babu by appreciating the above stated facts and circumstances.

ORDER

The petitioners have filed this petition seeking not to harass.

2.The contention of the learned counsel for the petitioners is that the first and second petitioners are the brothers of one Sobanbabu, who is alleged to have eloped with one minor girl and under the guise of enquiry, the petitioners had been called during odd hours and caused harassment. 3.The learned Government Advocate (Crl.side) submits that the minor girl aged about 17 years has been kidnapped and forcibly taken by the petitioners. girl lodged a complaint and case in Cr.No.1830/2020 registered. The said Shoban Babu is a lorry driver, he taken the victim girl forcibly to North India and whereabouts is yet to be ascertained. To secure the victim girl, the petitioners are necessarily to be examined.

4.In view of the above facts, this Court is not inclined to entertain the petition. Further, calling for enquiry, to secure the minor girl would not be termed as harassment. Admittedly, the first and second petitioners are brothers and the third and fourth petitioners are the relatives of Soban Babu, who said to have kidnapped the minor girl. Accordingly, the criminal original petition is dismissed.
