ORDER

The petitioner, who was arrested and remanded to judicial custody on 08.04.2026 for the alleged offences under Sections 8 (c) r/w 20 (b) (ii) (B), 22 (b), 25 of NDPS Act and Sections 274, 275, 123 of BNS, in Crime No.178 of 2026 on the file of the respondent police, seeks bail.

2. The case of the prosecution is that based on secret information, the Police arrived near Vyasarbadi North Avenue Public toilet on 08.04.2026 at about 09.00 a.m. The petitioner along with the other accused was found in possession of 1.3 kg of Ganja, 110 Nitravet Tablets and 210 Tydol Tablets.

Upon seeing the respondent Police, they attempted to flee from the scene, but were caught red-handed. Hence the case.

3.The learned counsel for the petitioner submitted that the petitioner is innocent and has been in custody since 08.04.2026. He further submitted that total recovery in this case is only 1.3kg of Ganja which is the threshold limit of the intermediate quantity. He further submitted that she is ready to abide by any stringent condition that may be imposed by this Court and ready to co-operate for investigation. Hence, he prays to grant bail to the petitioner. 4.The learned Government Advocate (Criminal Side) appearing for the respondent police submitted that the petitioner along with other accused was found in illegal possession of 1.3 kg of Ganja, 110 Nitravet Tablets and 210 Tydol Tablets. He further submitted that the petitioner has thirteen previous cases out of which one 302 I.P.C, nine NDPS cases and two other I.P.C. cases.

Hence, he opposed for grant of bail to the petitioner. 5.Taking into consideration the facts of the case and the submissions made by the learned Government Advocate, this Court is of the firm view that it is not an appropriate to enlarge the petitioner on bail. Hence, the Criminal Original Petition is dismissed.
