PRAYER: Writ Petition is filed under Article 226 of Constitution of India, pleased to issue a Writ of Certiorarified Mandamus, calling for all records pertaining to the Impugned Order passed by the Respondent his Proceeding No. C.No.58/PLR/B1PS/2023 Dated 16.06.2023 and quash the same and consequently directing the respondent to give permission to conduct cultural Programme (Adal Padal) at Perambalur District, Perambalur Taluk, Ranganthapuram Village, Arulmighu Sri Thambiran Swamy Thirukovil Festival on 28.06.2023.

ORDER

This Writ Petition has been filed calling for all records pertaining to the Impugned Order passed by the Respondent his Proceeding No. C.No.58/PLR/B1PS/2023 dated 16.06.2023 and quash the same and consequently directing the respondent to give permission to conduct cultural Programme (Adal Padal) at Perambalur District, Perambalur Taluk, Ranganthapuram Village, Arulmighu Sri Thambiran Swamy Thirukovil Festival on 28.06.2023.

The learned counsel for the petitioner submitted that the petitioner submitted a representation dated 15.06.2023 to the respondent, seeking permission for organizing Adal Padal event of Arulmighu Sri Thambiran Swamy Thirukovil Festival at Perambalur District, Perambalur Taluk, Ranganthapuram Village, on 28.06.2023. The said representation was rejected. Challenging the said order, this petition is filed.

3. In response, the learned Government Advocate (Crl.side) submitted that certain particulars which are required for granting permission were not complied with by the petitioner. That apart, the respondent Police apprehends law and order issue during the program on certain grounds. Therefore, the

permission sought for was rejected.

4. Considered the rival submissions and perused the records.

It is seen from the impugned order rejecting the permission sought for conducting Adal Padal program that, the petitioner has not made arrangements for installation of necessary CCTV cameras; there is no indication in the representation about starting and ending time of Adal Padal program; number of persons participating in the Adal Padal program. That apart, it was apprehended that if double meaning songs are played and against caste, it would create law and order problems. If the participants participate in the event after consumption of alcohol, there is a possibility of law and order issue and disturbance to the public.

6. In view of the reasons stated for rejection of permission for conducting Adal Padal program, this Court is of the view that this Court cannot interfere with the order of rejecting the permission sought for conducting Adal Padal program.

7. Accordingly, this Writ petition stands dismissed. No costs.

8. If the petitioner deems fit, he may file a fresh representation complying with all the requirements for conducting Adal Padal program on a different date. If such representation is submitted, the respondent Police is directed to consider the representation in the light of the circulars issued by the Director General of Police, Tamil Nadu, Chennai, in Rc.007301/Genl.I(1)/2019, dated 09.04.2019 and in Rc.03316/General.I(1)/2023, dated 01.06.2023 setting out the conditions to be followed before permission is given for the Adal Padal program.
