ORDER

This Criminal Original Petition has been filed by the petitioner under Section 483 of Bharatiya Nagarik Suraksha Sanhita (BNSS), 2023 praying to grant bail.

2. The petitioner/A7 was arrested and remanded to judicial custody on 26.10.2025 for the alleged offences punishable under Sections 310(2) and 318(4) of BNS [Sections 395 & 420 of IPC] in Crime No.341 of 2025 on the file of the respondent police.

The case of the prosecution is that the de-facto complainant at the instigation of one Dharma, who was known to him during his incarceration in a ganja case in the year 2020, went to Coimbatore with Rs.50 lakhs to do business by procuring old golds at lower price. During the course of their travel with the said amount, the defacto complainant and Dharma was intercepted by some unknown persons and took away the money from the said Dharma by assaulting him. Hence, the complaint was lodged by the defacto complainant, wherein the present petitioner was arrested.

4. The learned counsel for the petitioner submits that the petitioner is an innocent person and he has not committed any offence as alleged by the prosecution. He further submits that the petitioner has been in judicial custody since 26.10.2025. He also submits that some portion of the amount was recovered and co-accused were granted bail. He further submits that the petitioner is ready to abide by any stringent conditions that may be imposed by this Court. He therefore prays to grant bail to the petitioner.

5. Per contra, the learned Government Advocate (Crl. Side) appearing for the respondent police, submits that the previous bail petitions filed by the petitioner herein were dismissed by this Court on 06.03.2026 and 30.04.2026 and he further submitted that investigation has been completed and charge sheet has been filed in this matter. He also submitted that gold worth to the tune of Rs.35 lakhs has been recovered. Accordingly, he prays to dismiss this Criminal Original Petition.

6. Heard on both sides and also perused the materials available on record.

7. On perusal of the case reveals that the gold worth about Rs.35 lakhs was recovered in this matter and the co-accused were granted bail.

8. Considering the facts and circumstances of the case and some portion of the gold worth about Rs.35 lakhs was recovered and also taking into account, the period of incarceration undergone by the petitioner, this Court is inclined to grant bail to the petitioner, however on certain conditions. Accordingly, bail is granted to the petitioner subject to the following conditions: (i) The petitioner shall execute a bond for Rs.1,00,000/- (Rupees One Lakh only) and furnish two sureties each for a like

sum of Rs.25,000/- (Rupees Twenty Five Thousand only) to the satisfaction of the learned Judicial Magistrate No.I, Coimbatore; (ii) The sureties shall affix their photographs and left thumb impression in the Application for Suretyship [Judicial Form No.46 annexed to 'The Criminal Rules of Practice, 2019']. The learned Judicial Magistrate No.I, Coimbatore shall obtain a copy of any one of their identity proofs to ensure their identity; (iii) The petitioner shall stay at Coimbatore and appear and sign before the respondent police daily twice at 10.00 a.m., and 5.30 p.m., until further orders;

(iv) The petitioner shall not leave Coimbatore without obtaining prior permission from the Judicial Magistrate No.I, Coimbatore;

(v) The petitioner shall not, directly or indirectly, cause any threat to the witnesses;

(vi) On breach of any of the aforementioned conditions, the learned Judicial Magistrate No.I, Coimbatore is entitled to pass

appropriate orders against the petitioner in accordance with law as if the aforementioned conditions are imposed by them as laid down by the Hon'ble Supreme Court in P.K.Shaji Vs. State of Kerala [(2005)13 SCC 283].

9. Accordingly, this Criminal Original Petition is allowed subject to the conditions stated supra.
