2. Today, an additional affidavit has been filed by the appellant supported with reasons in paragraph 4 for the condonation of delay of 234 days in filing the Writ Appeal.

3. Though, we are not inclined to condone the delay, since Writ Appeals filed by the State on the same issue are pending before this Court, the delay of 234 days in filing the Writ Appeal is condoned and this Miscellaneous Petition is ordered upon proof of payment of Rs.10,000/- (Rupees ten thousand only) payable to High Court Legal Services Committee.

4. Registry is directed to number the Writ Appeal, if it is otherwise in order, and list the same for admission.
