Respondents Prayer: Petition filed under Article 226 of the Constitution of India for issuance of a Writ of Mandamus directing the 1st and 2nd respondents to remove the encroachment from the Government pathway an extent of 0.55 Sq.m in survey No.97/24 situated at Udhayamampattu Village Kallakurichi Taluk Villupuram District which encroached by the 3rd respondent by considering petitioners representation dated 06.05.2019 an accordance within the time stipulated.

ORDER

(Order of the Court was made by The Hon'ble Chief Justice) The matter was adjourned on September 20, 2021 since the petitioner was not represented.

2. However, since the petition was pending, the Tahsildar, Kallakurichi District, has conducted an inquiry which reveals that there is encroachment and the matter has been reported to the Executive Officer, Thiyagadurgam Town Panchayat. https://hcservices.ecourts.gov.in/hcservices/

3. The encroachment which has been discovered should be removed as expeditiously as possible by following the procedure

established by law. The concerned Executive Officer will report due compliance to the District Collector, once the encroachment is removed in accordance with law.

4. W.P.No.19846 of 2021 is disposed of. There will be no order as to costs.
