ORDER

The petitioner, who was arrested and remanded to judicial custody on 13.07.2025 for the alleged offence under 8 (c) r/w 20(b)(ii)(A), '22(C), 25, 29(1) NDPS Act 1985 in Crime No.494 of 2025 on the file of the respondent police, seeks bail.

2. The case of the prosecution is that A1 was found in possession of 5.25 grams of Methamphetamine in his two wheeler. Hence, this case.

3. The learned counsel for the petitioner submitted that the petitioner has been falsely implicated in this case and he has not committed any offence as alleged by the prosecution. He further submitted that the petitioner is in custody since 13.07.2025 and he is ready to abide by any stringent conditions that may be imposed by this Court. Hence, he prays to grant bail to the petitioner.

4. The learned Government Advocate (Crl. Side) strongly opposed the bail application on the ground that this Court on 16.04.2026 has dismissed the earlier bail application after considering all the contentions put forth by the learned counsel for the petitioner. He further submitted that there are no changes in the circumstances. Hence, he opposed the grant of bail to the petitioner.

5. I have given my anxious consideration to either side submissions and perused the materials available on record.

6. Considering the facts and circumstances of the case; taking note of the submission made by the learned Government Advocate (Crl.Side); it is seen

that this is a case of commercial quantity and the bail application of this petitioner was earlier dismissed on 16.04.2026 and the petitioner could not submit any ground deviating from the earlier finding, thus this Court is of the view that there is no change in circumstances, hence, this Court is not inclined to enlarge the petitioner on bail.

7. Accordingly, this Criminal Original Petition stands dismissed. 04-06-2026 SHL To:
