ORDER

This Writ Petition has been filed seeking issuance of mandamus, directing the 2nd respondent to grant compensation for the patta land acquired by SIPCOT Industries, Tindivanam in Survey No.214/ 07, DK. No.37/ 1405 Punjai Tharisu land situated in Kollar Village, Tindivanam Taluk, admeasuring about 0.21.0 Heactares (52 Cents).

2. The learned counsel for the petitioner would submit that in the present case, the petitioner purchased the property in the year 2010. Originally, the land was assigned to the petitioner's vendor in the year 1996 and since the petitioner purchased the assigned land from the original assignor, either the original assignor or the petitioner failed to mutate the record therefore, in the revenue record, it appears that the land pertains to the Government therefore, the respondent would submit that the compensation was credited to the Government account. Since the petitioner made a representation dated 19.09.2022, the respondent replied that if the petitioner can produce the record regarding

purchase of the property, they would consider the representation and refund the compensation to the petitioner.

3. Heard the learned counsel appearing for the petitioner as well as the respondent and perused the material available on record.

4. In the present case, the subject land was assigned to the petitioner's vendor in the year 1996 and the said assignee sold the property in the year 2010 to the petitioner. It is settled law that in the event of assignment, the revenue records supposed to have mutated by the respondents. It is failure on the part of the respondents that even after the assignment to the petitioner's vendor, it should have been automatically mutated however, the respondents failed to do so. Therefore, it is only the fault on the part of the respondents.

Such being the case, the petitioner is directed to produce all the records before the respondents with regard to the assignment of the land in favour of the petitioner's vendor as well as the sale deed. After verification of the same, the 2nd respondent is directed to conduct enquiry and pass orders on the petitioner's representation dated 19.09.2023 and pay compensation in favour of the petitioner along with interest within a period of twelve weeks from the date of receipt of a copy of this order.

6. Accordingly, this Writ Petition is disposed of with the above terms. No costs.
