ORDER

The petitioner, who was arrested and remanded to judicial custody on 10.01.2026 for the alleged offence under Sections 304 and 331(4) of BNS in Crime No.600 of 2025 on the file of the respondent police, seeks bail.

The case of the prosecution is that the petitioner trespassed into the house of the de facto complainant and committed theft of 4 1⁄4 sovereigns of gold jewelry. Hence, the case.

The learned counsel for the petitioner submitted that the petitioner is an innocent and he has been falsely implicated in this case. He further submitted that the investigation in this case has been completed and charge sheet has also been filed. He also submitted that the petitioner is ready to abide by any stringent condition that may be imposed by this Court. Hence, he prayed for grant of bail to the petitioner.

At this juncture, the learned Government Advocate (Criminal Side) strongly opposed the bail application on the ground that the petitioner has got 31 previous cases.

I have considered the submissions made on both sides and also perused the records available.

From the submissions made by the learned Government Advocate (Criminal Side) and the details placed before this Court, this Court is of the firm view that whenever the petitioner was enlarged on bail, he subverted justice and thereby, became a menace to society. Therefore, while this Court is conscious to

the liberty of the petitioner, the interest of the society must also be protected. Hence, considering the larger interest of the society, this Court is not inclined to enlarge the petitioner on bail.

Accordingly, this Criminal Original Petition is dismissed. 02-06-2026 VKR To 1.The Judicial Magistrate, Sangarapuram.
