Mr.A.Selvendran in both W.Ps Special Government Pleader COMMON ORDER By the consent of both parties, these writ petitions are taken up for final disposal at the admission stage itself.

These writ petitions are filed praying for a writ of mandamus to direct the third respondent Tahsildar to pass orders on the basis of the representations dated 04.10.2024 and 07.10.2024, whereby, the petitioners have sought issuance of patta in respect of the property comprised in S.No.191/5, measuring an extent of 0.04 acre (1742 Square Feet) in Thiruporur Village and Taluk, Chengalpattu District.

3. It is submitted by Mr.R.Naresh Kumar, learned counsel for the petitioners that the petitioners' father was originally allotted the subject land. After the demise of the petitioners' father, the petitioners' mother, namely Sakunthalaammal, settled the above land in favour of three sons, including the petitioners. She allotted each of them 0.04 acres respectively. The above deed of settlement Page No.2 of 6

was also registered before the Sub-Registrar office, Thiruporur vide Document no.1388 of 1986.

4. It is submitted by the petitioners that they have been in possession and enjoyment of the above property. The petitioners have taken out applications dated 04.10.2024 and 07.10.2024 for issuance of patta in their name.

It is submitted by Mr.A.Selvendran, learned Special Government Pleader for the respondents that the pleadings in the affidavit are vague and there are no documents which have been kept in the typed-set of papers which would indicate that the Government has in fact allotted the subject property to the petitioners' father, through which the petitioners seek to claim title over the subject property.

6. In any way, the learned Special Government Pleader would submit that it is open to the petitioners to submit any other documents in support of their claim for issuance of patta, which would be considered and appropriate orders would be passed, on merits and in accordance with law, after putting the petitioners, the Page No.3 of 6

other legal heirs of Late Sakunthalaammal and/or any other interested parties on notice, within a period of twelve weeks from the date of receipt of the uploaded copy of the order. The same is accepted to by the learned counsel for the petitioner.

7. Recording the submissions made by the learned Special Government Pleader, the present writ petition stands disposed of. It is made clear that this Court has not expressed any views with regard to the merits of the representation and it is open to the concerned respondent to consider the representation on its own merits and in accordance with law. There shall be no order as to costs.
