O R D E R
This writ petition has been filed to seek a Writ of Certiorarified Mandamus, challenging the order passed by the 3rd respondent dated 28.01.2019 bearing reference No.HRM/GEN/1385/2018-19 and consequently, directing the respondents to extend all the terminal benefits to the petitioner as per Office Memorandum of the Ministry of Personnel, PG & Pensions, Department of Pension & Pensioners' Welfare dated 30.11.2021.

On the ground that the verification on the genuineness of the petitioner's Community Certificate was pending before the State Level Scrutiny Committee, the petitioner's request for settlement of terminal benefits came to be rejected on 28.01.2019. Challenging this order of rejection, the present writ petition has been filed. 2/4

Today, when the matter was called, the learned counsel for the petitioner produced a copy of proceedings of the State Level Scrutiny Committee dated 28.01.2022, which states that the petitioner does not belong to 'Kondakapus' Scheduled Tribe Community and thereby, had cancelled his Scheduled Tribe Community Certificate. While that being so, it would not be appropriate to interfere with the rejection order passed by the respondents. However, if at all, the petitioner is aggrieved against the order passed by the State Level Scrutiny Committee, liberty is granted to him to work out his remedy in the manner known to law. With the above liberty, this Writ Petition stands closed. Consequently, connected miscellaneous petition is closed. There shall be no order as to costs.
