ORDER

This Criminal Original Petition has been filed, seeking to direct the respondent not to harass the petitioner under the guise of enquiry to settle money or cheques.

2. The learned counsel for the petitioner submitted that the petitioner had introduced the 2nd respondent to the petitioner's uncle namely, Loganathan as an Astrologer. Thereafter, there was an independent financial transaction between Loganathan and the 2nd respondent. While so, Loganathan met with a road accident and died on 22.06.2023. Subsequently, it came to light that the 2nd respondent had advanced a loan to the tune of Rs.14,00,000/- to Loganathan. After the death of Loganathan, his family members continue to pay a sum of Rs.10,000/- per month through the petitioner. Since there was a delay in repayment of the amount, the 2nd respondent lodged a complaint before the respondent police on 10.02.

2026, alleging that the petitioner and his wife had borrowed a money from the 2nd respondent for the medical treatment of the petitioner's mother. Pursuant thereto, the petitioner and his wife were called for enquiry and they have appeared before the respondent police on 13.03.2025 and 25.03.2026 and gave their explanation and also produced the Bank Statement of Loganathan's family. However, the respondent police under the guise of enquiry compelling the petitioner to settle the dues payable by the deceased Loganathan to the 2nd respondent.

3. Per contra, the learned Government Advocate (Crl. Side) appearing for the respondent submitted that, based on the complaint lodged by the 2nd

respondent, CSR No.0045 of 2026 was registered on 10.02.2026. He submitted that Loganathan had been introduced to the 2nd respondent by the petitioner and that both the petitioner and Loganathan had dealings with the 2nd respondent. He further submitted that taking advantage of the death of Loganathan, the petitioner is attempting to evade the liabilities due to the 2nd respondent. Thereafter, the petitioner was called for enquiry. However, he fairly submitted that the petitioner's wife is not required for further enquiry.

4. It is also submitted by the learned Government Advocate (Crl. Side) that, if the presence of the petitioner is required for enquiry, summons would be served to him in accordance with law. He further submitted that, the enquiry in CSR No.45 of 2026 would be completed, within a period of two months from the date of receipt of a copy of this order.

5. Recording the said submission made by the learned Government Advocate (Crl. Side), this Criminal Original Petition stands disposed of. 05-06-2026 Jd
