Mr.K.Madhan COMMON ORDER The husband filed both the petitions seeking to withdraw HMOP.No.434 of 2022 and HMOP.No.20 of 2022 both pending on the file of the learned Sub Judge, Alandur, and to transfer the same to the file of the learned Additional Family Judge, City Civil Court, Chennai.
2. The husband has filed HMOP.No.434 of 2022 seeking restitution of conjugal rights and HMOP.No.20 of 2022 seeking divorce on the ground of cruelty. The learned Trial Judge has kept the applications filed to issue summons to the employer of the wife unnumbered and posted the same to argue on the ground of maintainability. Hence, the husband has moved these transfer petitions.
3. Upon considering the submissions of the learned counsel appearing on either side, it is seen that the child is under the care and custody of the mother and both the husband and wife are making allegations against each other. As the
child is under the care and custody of the mother, the father is bound to maintain the child.
4. In view of the above, HMOP.No.434 of 2022 and HMOP.No.20 of 2022 pending on the file of the learned Sub Judge, Alandur is withdrawn and transferred to the file of the learned II Additional Family Judge, City Civil Court, Chennai. The petitioner/father is directed to pay to Rs.15,000/- every month from the month of July, 2026 as maintenance to the child until further orders to be made by any court of law. If at all any interlocutory application is filed by the petitioner, it ought to be taken on file and considered on merits.
5. With the above directions, these transfer civil miscellaneous petitions are ordered. Consequently, the connected miscellaneous petitions are closed. 24-06-2026 nl Index: Yes/No Speaking/Non-speaking order
