ORDER

This Criminal Original Petition has been filed to direct the learned Magistrate to conduct speedy trial and dispose C.C.No.122 of 2023 on the file of XXIII Metropolitan Magistrate Court, Saidapet, Chennai, within a time frame fixed by this Court.

2.The petitioner, who is the de facto complainant in Crime No.233 of 2022 on the file of the respondent Police, registered for the offences under Sections 406 and 420 IPC, which has culminated into C.C.No.122 of 2023 on the file of the XXIII Metropolitan Magistrate Court, Saidapet, Chennai, has filed the present petition seeking speedy trial. 3.The contention of the petitioner is that, though charge-sheet has been filed in the year 2023, for some reasons, the case has been periodically adjourned without any progress and the petitioner is denied justice. 4.The learned Government Counsel (Criminal Side) appearing for the respondent Police submitted that, in this case, the petitioner had been examined as P.W.1 and for marking other documents, chief-examination of P.W.1 has not been completed and the case has been adjourned to 11.06.2026, on which date, P.W.1's chief-examination will be completed. Further, he submitted that there are only 8 witnesses in this case and examination of all witnesses will be completed within the stipulated period.

5.Considering the submissions made by the learned Government Counsel (Criminal Side), this Court directs the trial Court to give preference to the case in C.C.No.122 of 2023 and ensure that the trial is completed preferably within a

period of nine months from the date of receipt of a copy of this order.
