The petitioners, who apprehend arrest at the hands of the respondent police for the alleged offences under Section 392 IPC in Crime No.105 of 2023 on the file of the respondent police, seek anticipatory bail.

2. Learned counsel for the petitioners submitted that, petitioners are falsely implicated in this case in Crime No.105 of 2023 for the offences under Section 392 IPC. Petitioners are innocents. Apprehending arrest at the hands of the respondent, this petition is filed.

3. Learned Government Advocate (Criminal side), opposes this petition, on the ground that, on 21.05.2023 at about 10.30 p.m., when the defacto complainant and his friends were going in Railway Border Road, Aswin and Aparna were waylaid by two persons and they picked up fight with them. When defacto complainant and Dinesh asked, what happened, two persons forcefully took Dinesh and the defacto complainant to a dark place and taken bluetooth, headset and Rs.2,000/- from them. They had

also beaten Dinesh. It is seen from the submissions of the learned Government Advocate (Criminal side) that, out of three accused, only 3rd accused was arrested and only Rs.500 was recovered. The remaining properties are not recovered. Thus, he prays for dismissal of this petition.

4. Considering the nature of the allegations made in the petitioners and that remaining properties are not recovered from the accused and others are absconding, this Court is not inclined to grant anticipatory bail to the petitioners.

5. Accordingly, this Criminal Original Petition is dismissed. 13.07.2023 gd
