O R D E R

This Criminal Miscellaneous Petition has been filed seeking relaxation of the condition in Paragraph No.8 (iii), namely, "the petitioner shall appear before the Trial Court on the first working day of every week at 10.30 a.m. until further orders" as imposed vide order dated 04.02.2026 in Crl.M.P.No.24399 of 2025 in Crl.A.No.1936 of 2025, arising out of the judgment dated 01.12.2025 passed against the petitioner / A2.

2. The learned counsel for the petitioner submitted that the petitioner is a resident of Visakhapatnam and has complied with the conditions imposed by this Court so far. It is further submitted that the petitioner is a labourer and therefore, finds it difficult to travel to Chennai every week. Hence, the learned counsel seeks relaxation of the condition stipulated in Paragraph No.8(iii).

3. The learned Government Advocate (Criminal Side) appearing for the respondent police submitted that the petitioner has been complying with the conditions imposed by this Court without any deviation. 2/5

4. I have considered the submissions made by the learned counsel for the Petitioner and the learned Government Advocate (Criminal Side) appearing for the respondent police.

5. Taking note of the fact that the petitioner has been complying with the conditions imposed by this Court without any deviation, and also considering the hardship and expenses involved in travelling to Chennai every week, I am inclined to modify the condition imposed vide order dated 04.02.2026 in Crl.M.P.No.24399 of 2025 in Crl.A.No.1936 of 2025. Accordingly, the condition that "the Petitioner shall appear before the Trial Court on the first working day of every week at 10.30 a.m until further orders" is modified to the effect that "the petitioner shall appear before the Trial Court on the first working day of every month at 10.30 a.m., pending disposal of the present appeal."

6. All other conditions imposed earlier shall remain unaltered.
