PRAYER : Writ Petition filed Under Article 226 of the Constitution of India praying for issuance of Writ of Certiorari calling for the records relating to the proceedings of the 3rd respondent in P.R.No.D1/Sec/4/2012 dated 07/11/2012, and quash the same.

The charge memo issued against the writ petitioner under Rule 3(b) of the Tamil Nadu Police Subordinate Services (Discipline & Appeal) Rules, 1955, is under challenge in the present writ petition.

2. Charges are framed against the writ petitioner under the Conduct Rules 1964. The learned counsel for the petitioner contended that the charges are flimsy in nature. However, the allegation reveals that the petitioner while working as https://hcservices.ecourts.gov.in/hcservices/

Inspector of Police directly given a petition to the then Chief Minister requesting Tamil Nadu Housing Board plot. In respect of such allegations, an enquiry is imminent. At this juncture, the learned counsel for the petitioner made a submission that the petitioner may be permitted to submitted his explanation to defend his case.

3. The petitioner is entitled to submitted his explanation for defending his case and dispose the same as expeditiously as possible. The learned counsel for the petitioner sought for a permission to withdraw the writ petition. Accordingly, the writ petitioner is permitted to withdraw this writ petition with a liberty to defend his case.

Accordingly, this writ petition is disposed as withdrawn. No costs.
