This Criminal Original Petition has been filed by the petitioner/A3, who was arrested and remanded to judicial custody on 18.06.2024, seeking bail in Crime No.338 of 2024 registered for the offence under Sections 399 and 402 of IPC.

2. Learned counsel appearing for the petitioner submitted that the petitioner is an innocent person and he has been falsely implicated in this case. He further submitted that the petitioner is no way connected with the alleged offence and is in custody from 18.06.2024. Hence, he prayed to grant bail to the petitioner stating that he is ready to abide by any stringent conditions that may be imposed by this Court.

3. Learned Government Advocate (Criminal Side) appearing for the respondent police objected for granting bail stating that the petitioner/A3 along with four other accused, unlawfully assembled and planned to commit dacoity, thereby, the respondent arrested the accused and seized the knife from them. He further submitted that the case is under investigation, since accused 4 and 5 are still absconding and also submitted that the petitioner is a habitual offender having 11 previous cases including the cases registered under Sections 302 & 307 IPC, therefore, if he is released on bail, there is every possibility of him absconding and not available for further investigation. Taking into consideration the facts and the submissions made by the learned Government Advocate (Crl.Side) that some of the accused are still absconding and the petitioner/accused was arrested only on 18.06.2024 and also considering the antecedents of the petitioner, this Court is not inclined to grant bail to the petitioner.
