Prayer: Writ Petition filed under Article 226 of the Constitution of India, praying to issue a Writ of Mandamus to direct the 5th respondent to initiate the proceedings to correct the Field Map Sketch of Survey No.50B/5 at Irumbuliyr Village, Tambaram Taluk, Chengalpattu District on the basis of the order passed by the 3rd respondent in Na.Ka.A7/0096/2024 dated 09.02.2024 within a time frame fixed by this Court. By consent of both sides, this Writ Petition is disposed of at the stage of admission itself.
2. The grievance of the petitioner is that there is a mistake in the field map sketch of S.No.50B/5, in this regard, the petitioner had made representation to the respondents 1 to 4 on 12.01.2024, based on the representation the 3rd respondent in his proceedings Na.Ka.A7/0096/2024 dated 09.02.2024 directed the 5th respondent to enquire into the matter and forward a report to the DRO/2nd respondent herein. However, no orders have been passed, hence the present petition. 2/5
3. The learned Special Government Pleader for the respondents submit that pursuant to the proceedings of the 3rd respondent, the 5th respondent will conduct an enquiry and forward the report to the 2nd respondent, as the 2nd respondent is the competent person to pass appropriate orders on the representation of the petitioner.
4. Heard the learned counsel for the petitioner and the learned Special Government Pleader for the respondents 1 to 5 and perused the materials available on record.
5. In such view of the matter, the fifth respondent is hereby directed to conduct an enquiry with a period of two months from the date of receipt of a copy of this order, after giving notice to the neighbouring land owners and any other interested persons, and forward the report to the 2nd respondent. In turn, the 2nd respondent is directed to pass orders based on the report of the Tahsildar/5th respondent within a period of one month thereon. 3/5
6. With the above direction, this Writ Petition is disposed of. No costs.
