Respondent Prayer: The Criminal Miscellaneous Petition has been filed under Section 482 of Cr.P.C. to extend time of three months time to complete the investigation and to file the final report in R3, Ashok Nagar P.S., Cr.No.2407 of 2013, Chennai and also to comply with the direction of this Court passed in Crl.O.P.No.14519 of 2020, dated 17.09.2020.

ORDER

The Criminal Miscellaneous Petition has been preferred by the petitioners/respondents in Crl.O.P.No.14519 of 2020 seeking for extension of time of three months to complete the investigation and file the final report in Crime No.2407 of 2013 on the file of the third respondent viz., The Inspector of Police (Crime Branch), R3, Ashok Nagar Police Station, Ashok Nagar, Chennai - 600 083 as directed by this Court by order dated 17.09.2020 in Crl.O.P.No.14519 of 2020.

2.The Criminal Original Petition No.14519 of 2020 has been laid by the respondent seeking for a direction to the third respondent therein to file a final report in Crime No.2407 of 2013 within a specific time frame. This Court, after taking into consideration of the issues involved in this matter, directed the respondents police therein to complete the investigation in Crime No.2407 of 2013 and file a final report within a period of six weeks from the date of receipt of a copy of the order. 3.According to the petitioners, pursuant to the order passed by this Court, the investigation has been proceeded further and various evidences both oral and documentary, had been collected and further the petitioners have also been necessitated to wait for the out come of the civil suit in O.S.No.

7068 of 2012 on the file of the XVIII Additional City Civil Court at Chennai preferred by one M.Vasuki, sister of the respondent and the abovesaid suit has come to be dismissed on 20.06.2019 and furthermore, due to the intervention of the Pandamic situation on account of Covid-19, as the police were deployed in connection with the abovesaid work and despite the same, inasmuch as the statement of accounts pertaining to the accused person ought to be collected and the bank accounts, balance sheets of the partnership firm, tax returns of certain individuals are to be collected, considering the abovesaid reasons, the present Crl.M.P. has been preferred seeking for extension of three months time to complete the investigation and file the final report.

4.At the time, when the Crl.M.P. is taken up for consideration, the counsel for the respondent contended that the petitioners have already been given sufficient time to complete the investigation and lay the final report and though some progress has been made in the investigation by the petitioners, the petitioners should be directed to conclude the investigation expeditiously without any further delay and accordingly, prayed that a suitable order may be passed in the petition. 5.Taking into consideration of the abovesaid factors in toto, considering the progress made in the investigation pursuant to the order passed by this Court dated 17.09.2020 in Crl.O.P.No.

14519 of 2020 as put forth by the petitioners, inasmuch as further oral and documentary evidence have to be collected qua the accused persons from the various sources for concluding the investigation, in the fitness of things, it is noted that sufficient time should be granted to the petitioners to conclude the investigation in Crime No.2407 of 2013.
