CRIME NO. 302 OF 2021.
Petition praying that in the circumstances stated therein the High Court will be pleased to modify the condition in para 6 as with two sureties, of whom, one should be Government surety, instead of the condition with two sureties, whom, of one should be blood related surety in Crl.O.P.No. 15273 of 2021 dated 25.08.2021. Order: This petition coming on for orders upon perusing the petition and upon hearing the arguments of M/S. B.VASUDEVAN, Advocate for the Petitioner and of MR. A.GOPINATH, Govt. Advocate ( Crl. Side) on behalf of the Respondent the court made the following order:- This petition has been filed for modification of the condition imposed on the petitioner vide order in Crl.O.P.No.15273 of 2021 dated 25.08.2021.
2. The learned counsel for the petitioner submits that vide order dated 25.08.2021, this Court had enlarged the petitioner on bail and imposed condition that " the petitioner shall execute a bond for a sum of Rs.10,000/- with two sureties, of whom, one should be a blood related surety, each for a like sum to the satisfaction of the learned Judicial Magistrate No.V, salem. He further submits that the father and mother of the petitioner is no more and so the petitioner is not able to provide a blood related surety. Therefore, he prays that the blood surety be modified as Government employee surety and the other would be a local surety.
2. Heard the learned counsel appearing for the petitioner and the learned Government Advocate (Criminal Side) appearing for the respondent police, who has no objection.
3. Considering the submissions made by the counsel on either side, this Court is inclined to modify the condition imposed on the petitioner made in Crl.O.P.No.15273 of 2021 to the effect that the petitioner shall execute a bond for a sum of Rs.10,000/-(Rupees Ten Thousand only) with two sureties of whom one shall be of Government employee surety and the other be a local surety.
4. Except for the above modification all other conditions would remain unaltered.
