ORDER
The application has been filed to grant leave to sue the defendants under Section 92(1) of the CPC.
2. Mr.M.Balasubramanian, learned counsel appearing for the applicants.

The suit has been initiated for removing the office bearers of the first defendant Trust even from the primary membership, to remove the 16th and 17th defendants as staff of the first defendant and for framing a scheme for the proper and smooth management of the religious and charitable activities of the first defendant. Various allegations have been raised as against the defendants, in respect of the management of the first defendant Trust. 2/5

The plaint also alleges that without any decision being taken by the office bearers of the Samaj, second defendant without any authority had demolished the temple and also removed the statue of Baba worshiped in the Temple with an intention to sell the same, and has also been pressurizing the other members of the committee to install a new statue, which has also been objected to by the office bearers.
5. I have perused the plaint and the documents filed in support of the plaint. Plaint discloses that as early as in the year 2001 a suit under section 92 was initiated seeking to frame a scheme. The said suit is still pending. It also further discloses that the Hon'ble Apex Court as early as in the year 2019 had directed disposal of the Suit by this Court. A memo had been filed by the learned counsel for the plaintiffs therein indicating that various defendants had passed away and that the plaintiffs are giving up their claim as against defendants 9 to 13. No amendments by way of impleading the necessary parties have also been effected by the plaintiffs therein. The petitioner before the Hon'ble Apex Court had been now elected as the secretary of the Samaj. Serious allegations have been made against him. The Samaj has been carrying out public and religious charitable works.

6. This court is satisfied on the materials which have placed by the plaintiffs, there is a prima facie sufficient cause for initiating the suit under the provisions of section 92 of CPC. Hence, the Application is allowed as prayed for and as a corollary, the Registry is directed to number the suit, if it is otherwise in order.
