The petitioner who apprehends arrest at the hands of the respondent police for the offences punishable under Section 328 of IPC, Sections 7, 20(1) of Cigarette and Other Tobacco Products Act, 2003, Sections 4(1)(a), 4(1-A) of TN Prohibition Act in Crime No. 197 of 2022, seeks anticipatory bail.

2. The case of the prosecution is that on 03.07.2022, the respondent police on a routine vehicle check-up at Poonapalli Police check-post intercepted a mini lorry bearing registration No.TN 54-V-1324. Upon confiscation, the respondent police seized banned tobacco products weighing 1,639 kilograms worth about Rs.8,04,000/- from the accused person. Hence, the case.

3. The petitioner is the owner of the contraband. The petitioner along with the other accused person was found in possession of huge quantity of banned tobacco products. Therefore, custodial interrogation of the petitioner is very much required.
