Prayer: This Writ Petition filed under Article 226 of the Constitution of India, to issue a Writ of Certiorari, calling for the records of the respondents 1 to 3 relating to the G.O.(D) No.73 Home (Police-2) Department dated 29.01.2013 of the first respondent and Proceedings bearing No.R.c.No.24619/ HR Cell/2013 dated 01.8.2013 of the second respondent and the consequential Memo bearing No.Rc.No.Crime III (2)/998/85312/2013 dated 03.04.2014 of the third respondent and quash the same.

ORDER

The petitioner challenges the order dated 29.01.2013 passed by the first respondent. By the said order, a sum of Rs.25,000/- is sought to be recovered from the salary of the petitioner following the order passed by the State Human Rights Commission, Tamil Nadu in SHRC Case No.401 of 2004/C2.

2. The SHRC on a complaint filed by one R.Venkatanarayanan through its order dated 28.11.2012 held that the petitioner had violated Human Rights to the 2/5

complainant and accordingly, directed the Government to make a payment of Rs.25,000/- towards compensation and in turn recover the said amount from the petitioner. The impugned order passed by the State is only consequential order pursuant to the order passed by the State Human Rights Commission, Tamil Nadu.

3. The petitioner seems to have filed Review Application in R.A.No.3 of 2014 for reviewing the order passed by the SHRC. In the event, the petitioner succeeds in the said Review Application, the petitioner can very well seek for reimbursement of the amount sought to be recovered by the State Government. Therefore, the Writ Petition stands disposed of with the aforesaid direction. Consequently, connected Miscellaneous Petitions are closed. There shall be no order as to costs.
