Crl.O.P.No.15109 of 2023 G.CHANDRASEKHARAN.J., The petitioner namely A.Aravindan, who apprehends arrest at the hands of the respondent police for the offence under Sections 294(b), 341, 448, 385 and 506(i) of IPC in Crime No.355 of 2023 on the file of the respondent seeks anticipatory bail.

2. The learned counsel for the petitioner submitted that, petitioner is an innocent person and he has been falsely implicated in a case registered for the offence under Sections 294(b), 341, 448, 385 and 506(i) of IPC in Crime No.355 of 2023. He further submitted that, petitioner's name is not mentioned in the FIR and he is implicated only based on the confessional statement of the arrested accused. Apprehending arrest, this petition is filed.

3. In reply, the learned Government Advocate (Crl. Side) submitted that, on 06.06.2023, accused had illegally trespassed into the defacto complainant's godown and abused the defacto complainant in unparliamentary words and also hit the workers and directed them not to 1/3

sell the scrap materials at lower cost. Accused also demanded Rs.5,00,000/- from the defacto complainant, else they would not allow the staff to leave the godown. There are three previous cases pending against the petitioner. Investigation in this case is not completed.

4. Though the name of the petitioner is not mentioned in the FIR, during the investigation, involvement of the petitioner is known. Considering the previous cases pending against the petitioner and the investigation in this case is not completed and the arrested accused are still in jail, this Court is not inclined to grant anticipatory bail to the petitioner.
