Advocate ( Crl. Side) PETITION FOR ANTICIPATORY BAIL Under Sec. 438 Cr.P.C. ORDER : The Court Made the following order :- The petitioners who apprehends arrest for the alleged offence under Section 379 of IPC, in Crime No.493 of 2021 on the file of the respondent police, seeks anticipatory bail.

2. The case of the prosecution is that the petitioners is involved in illegal transportation of 1⁄2 unit of river sand in a vehicle bearing number TN32CB1272. Hence, the complaint.

3. The learned counsel appearing for the petitioners submits that the petitioners did not committed any offence as alleged by the prosecution and they have been falsely implicated in this case. Hence, he prays for grant of anticipatory bail.

4. The learned Government Advocate (Crl. Side) submits that the illegal transportation of 1⁄2 unit of river sand in a vehicle bearing number TN32CB1272 without any valid permit. He further submits that on an ealier occasion this court dismissed the anticipatory bail application in Crl.O.P.No.14860 of 2021. Hence, he vehemently opposed for grant of Anticipatory bail to the petitioners.

5. Considering the facts and circumstances of the case and further the petitioner has involved in illegal mining of river sand, this court is not inclined to grant anticipatory bail to the petitioners.
