This Contempt Petition has been filed praying to punish the respondent for disobeying the order dated 19.03.2021 passed in 1/4
Crl.M.P.No.3405 of 2021 in Crl.O.P.No.5318 of 2021 on the file of this Court.
2. When the earlier order was passed by this Court on 02.09.2022, it was made clear that liberty is granted to the petitioner to independently challenge the final report and this Court directed the Mahila Court, Namakkal, to keep the proceedings in Spl.C.C.No.67 of 2021 pending. Till date, no petition has been filed challenging the final report. The interim protection was given by this Court only to ensure that the petitioner is not put to hardship and the petitioner takes steps to challenge the final report. Such an interim order cannot be taken advantage and the petitioner cannot continue to enjoy the interim order even without challenging the final report.
3. In view of the above, this Court is satisfied with the stand taken by the respondent and it is made clear that the petitioner will be at liberty to independently challenge the proceedings pending in Spl.C.C.No.67 of 2021, which is now pending on the file of Mahila Court, Namakkal.
