COMMON ORDER The writ petitions have been filed to direct the respondents to pay the interest at the rate of 8% per annum on the delayed payment of terminal benefits, including Provident Fund, Gratuity, Earned Leave, Commuted Pension, and other retirement benefits, within a specified time.
2. The learned counsel for the petitioners would submit that the petitioners had served in the respondent/Transport Corporation as Drivers and Conductors and retired from service after attaining the age of superannuation. Though their retirement benefits have been settled, the payments were made belatedly without any interest being paid to the petitioners. Hence, the petitioners sent their representations claiming interest upon the delayed payment of their retirement benefits.
3. At this juncture, the learned Standing Counsel appearing on behalf of the respondent/Transport Corporation would submit that in view of the order passed earlier in similar writ petitions, specifically W.P.Nos.33742 of 2024 and Page No.4 of 7
40031 of 2024, they are willing to pay the interest at the rate of 6% per annum upon the belated payment of the eligible and admissible amount to the petitioners.
4. In view of the submissions made, this Court deems it appropriate to direct the respondent/Transport Corporation to pay the interest at the rate of 6% per annum from the date of retirement till the date of actual disbursement of the terminal benefits to the petitioners, within a period of six (6) weeks from the date of receipt of a copy of this order.
5. In result, this Writ Petitions stand disposed of in the above terms. No costs.
