PETITION under Article 226 of The Constitution of India praying for the issuance of a Writ of Mandamus directing the respondents to return the fixed deposit amount based upon the representation given by the petitioner dated 23.3.2018. For Petitioner :

ORDER

Mr.Arumugha Rajan, learned Standing Counsel accepts notice for the respondents. Heard both. By consent, the writ petition itself is taken up for final disposal.

2. The petitioner has filed this writ petition to direct the respondents to consider the representation dated 23.3.2018, in which, the petitioner requested for refund of the security deposit of Rs.9,69,000/- made by him.

The petitioner would state that he is entitled to refund of the entire amount without deduction because he was not able to carry on the activities as per the licence on account of a third party conducting an illegal bar. It is further stated that this fact has been recorded by the third respondent while making a request to the Additional Director General of Police (Prohibition Enforcement Wing I & II) with a copy to the Inspector of Police (Law and Order), C3 Police Station, Waltax Road, Chennai-79 vide communication dated 02.1.2018.

4. The learned Standing Counsel for the respondents submits that a reasonable time may be granted to the third respondent to consider the said representation.

5. In the light of the above, the writ petition is disposed of by directing the third respondent to consider the representation of the petitioner dated 23.3.2018 after taking note of the facts recorded in the communication dated 02.1.2018 to the Additional Director General of Police (Prohibition Enforcement Wing I & II) and pass appropriate orders on merits and in accordance with law, within a period of two weeks from the date of receipt of a copy of this order. No costs.
