O.P.No.284 of 2022 C.V.KARTHIKEYAN, J., This Petition has been filed seeking probate relating to the Last Will dated 21.09.2018 executed by R.Seethalakshmi, who died on 09.06.2020.

The petitioner is the executor named under the Will. The first respondent is her husband and the second respondent is her son and the third respondent is a daughter of a predeceased daughter. They had given their consent affidavits.

The petitioner examined himself as PW-1. The original Will dated 21.09.2018 was marked as Ex.P-1. The death certificate of R.Seethalakshmi was marked as Ex.P-6 and the death certificate of her daughter / mother of the third respondent was marked as Ex.P-7. The legal heirship certificate of R.Seethalakshmi was marked as Ex.P8 and the legal heirship certificate of her daughter was marked as Ex.P-9. The consent affidavits of all the three respondents were marked Exs. P-11 to P-13.

To further prove the Will, the petitioner also examined Mrs.L.Rama as PW-2 and Mr.C.R.Sampath Kumar as PW-3. They were the attesting witnesses and both of them identified the Will and also stated that they all signed at the same time and the testatrix also signed at the same time in their presence. They specifically stated that the testatrix was in a sound and disposing statement of mind at the time of execution of the Will.
5. In view of evidence recorded, the probate of the Will executed by R.Seethalakshmi is granted and this Original Petition is allowed as prayed for.
