The Relief sought for in the present Writ Petition is to direct the 1st respondent either to release 460 bags of rice each 75 Kg or disburse the market value of the 460 bags of rice. https://hcservices.ecourts.gov.in/hcservices/
2.The petitioner is modern rice mill and running the same in the name and style of Sri Sivarama Modern Raw and Boiled Rice Mill. The petitioner sold 460 bags of rice each 75 kgs under a cover of valid bill and valid permit issued by the Government of Andhra Pradesh. However, the Salem Revenue Officials, seized the lorry and rice bags were confiscated and a Criminal Case was also registered. It is brought to the notice of this Court that against the order passed by the District Judge, Salem, a Criminal Revision Petition is also filed before this Court by the petitioners. When a Criminal Case is registered and the rice bags were seized by Police, this Court cannot grant any relief in writ proceedings under Article 226 of the Constitution of India and any such issues are to be dealt with by following the procedures contemplated under the Code of Criminal Procedure. Thus, the petitioner is at liberty to redress his grievances in the manner known to law.
3. With these observations, the writ petition stands dismissed. No costs. Consequently, connected miscellaneous petition is closed.
