ORDER : The Court Made the following order :- The petitioner, who was arrested on 06.07.2021 and remanded to judicial custody for the offences under Sections 406 and 420 of IPC, in Crime No.624 of 2021 on the file of the respondent police, seeks bail.

2. This is the second bail application filed before this Court. The case of the prosecution is that the petitioner had received a sum of Rs.3,03,000/- from the defacto complainant by promising him to get medical seat to the defacto complainant's son, but failed to get medical seat, not returned the money. Hence the complaint.

3. The learned counsel for the petitioner submitted that the petitioner is no way connected with the alleged offence and he has been falsely implicated in this case and the petitioner has been in jail from 06.07.2021. Therefore, he prays to grant bail to the petitioner.

4. The learned Government Advocate (Crl.Side) appearing for the respondent submitted that the petitioner has received Rs.3,03,000/- from the defacto complainant, neither get the medical seat nor returned the money, thereby cheated the defacto complainant. He further submitted that earlier bail application was dismissed by this Court in Crl.O.P.No.13838 of 2021 dated 09.08.2021 and there is no change of circumstances. Hence, he vehemently opposed for grant of bail to the petitioner.

5. Considering the facts and circumstances of the case and also the fact that the petitioner has involved in very serious offence and earlier bail application was dismissed by this Court and there is no change of circumstances, this Court is not inclined to grant bail to the petitioner.
