ORDER
This Miscellaneous Petition has been filed to direct the respondents to keep one post of Assistant Engineer (Electrical )(Post code-3266) vacant for each petitioner pending disposal of the W.P. No.10656 of 2025.

The learned counsel for the petitioner would submit that at the time of the initial notification, there was no upper age limit fixed, and after the written examination, an upper age limit of 34 years was fixed for the post of Assistant Engineers. It is the submission of the learned counsel for the petitioner that the petitioner crossed the age of 34 years on the date of the notification, and if the second respondent is permitted to introduce a new qualification of an age limit of 34 years, it would greatly affect his career prospects and also would amount to changing the rules in the mid-way. He also drew the attention of this Court to the vacancy position of Assistant Engineer (Electrical) as on 29.05.2025 and would submit that there are four vacancies and one post has to be reserved for the petitioner.

At this juncture, the learned Standing Counsel appearing for the second and third respondents would draw the attention of this Court to the fact that the available post is for differently abled candidates and the petitioner is not a differently abled person. Therefore, even if one post is reserved, it would not
hold for the petitioner. This Court also saw the vacancy position submitted by the petitioner. As rightly contended by the learned Standing Counsel, the available vacancies are earmarked for differently abled candidates. Therefore, this Court finds no merits in the Miscellaneous Petition and it is liable to be dismissed.
4. Accordingly, this Miscellaneous Petition is dismissed. However, this Court make it clear that, any appointments to be made by the Tamil Nadu Public Service Commission in the impugned notification are subject to the result of this Writ Petition.
