ORDER

This Petition has been filed seeking extension of time to comply with the condition imposed by the Lower Appellate Court while ordering suspense of sentence.

2. The Appeal arising out of conviction under Section 138 of the Negotiable Instrument Act was entered by the Lower Appellate Court and order suspense of sentence on payment of 20% of the out of cheque amount within a period of 60 days. The time was expired on 31.05.2024.

3. The petitioner is not able to mobilise Rs.90,000/- being 20% of the cheque amount due to illness, came before this Court seeking extension of time and to show his bona fide, he has also drawn a demand draft of Rs.90,000/- in favour of Chief Metropolitan Magistrate, Egmore, drawn at Indian Bank, bearing No. 176932 dated 06.08.2024.

4. This Court is satisfied regarding the reasons given by the petitioner for extension of time.

5. Hence, time is extended and this Criminal Original Petition stands closed.

6. The petitioner is directed to deposit the demand draft before the learned II Fast Track Court, Allikulam, Chennai, in C.C.No. 7968 of 2018, within a period of ten days from today.
