Prayer :- Writ Petition is filed under Article 226 of the Constitution of India directing the respondents to pay the interest accrued on my both EPF contributions which amounts to Rs.16,06,180/- (Rupees Sixteen Lakhs six thousand one hundred and eighty only) considering petitioner detailed representations dated 08.02.2025 and 30.04.2025 within stipulated time.

O R D E R

The petitioner seeks a mandamus to the respondents to pay the interest that has accrued on his EPF contribution totalling a sum of Rs.16,06,180/- by considering his representations dated 08.02.2025 and 30.04.2025.

2. The facts are briefly set out herein below:- 2/6

3. The petitioner had joined the services of the 4th respondent society as a salesman on a daily wage basis in the year 1984. Thereafter, he was promoted as a Fertilizer Salesman on 01.09.1989 and a Junior Clerk and a Senior Clerk on 01.03.1999 and 06.07.2022, respectively. On 31.07.2022, the petitioner had retired from the services. He had put in 38 years of unblemished service in the 4th respondent society and there were no disciplinary action or surcharge action or criminal charges against the petitioner. The 4th respondent had also permitted the petitioner to retire from its service on 31.07.2022. However, the petitioner came to learn that the 4th respondent had not paid the interest that had accrued on the petitioner's EPF contribution. Since the same was not paid, the petitioner had sent detailed representations to pay the interest amount on 08.02.2025 and 30.04.2025. However, to date no action has been taken on the said representations. Therefore, the petitioner is before this Court.

4. Heard the counsels on either side.

Considering the limited request and the fact that the respondents have failed to discharge their statutory duties, directions are issued to the respondents to consider the representations of the petitioner and pass orders in accordance with law within a period of 6 weeks from the date of receipt of a copy of this order.
