Respondents PRAYER: The writ petition filed under Article 226 of the Constitution of India, to issue a Writ of Certiorarified Mandamus, a)calling for the records relating to Legal Heir Certificate No.TN-7202211102197, dated 25.11.2022 issued by the 4th respondent in favour of the said 7th respondent herein and quash the same as illegal, non-est and void, b) alternatively, transfer the 3rd respondent enquiry with respect to forged legal heir certificate No.TN-7202211102197, dated 25.11.2022 issued by the 4th respondent in favour of the said 7th respondent to any other Revenue Divisional Officer to any other district. ORDER
When the matter came up before this Court on 01.09.2023, this Court passed the following order;
"The petitioner is the legal heir of the late Rajagopal, whereas the seventh respondent herein approached the Tahsildar for issuing a legal heir certificate on the ground she was first married to the late Rajagopal. The petitioner objected to this, and therefore, it was not 2/4
given by the Tahsildar. Thereafter, the seventh respondent would file a Civil Suit for declaration for her status and later withdrew the same. Subsequently, she filed a suit for administration of Rajagopal's estate, which was dismissed and the same was also confirmed by the First Appellate Court in A.S.No.222 of 2014. Now, after all the drama, the seventh respondent had again moved the Tahsildar for an identical relief, which was rejected sometime in 1999. However, the present Tahsildar has issued her one without any enquiry." 2.Today, there is no representation for the petitioner. 3.Mr.M.Bindran, the learned Additional Government Pleader appeared for the respondents.
4.This writ petition stands dismissed accordingly for default. No costs. Consequently, the connected miscellaneous petition is closed. 19.09.2023 kas Index : yes / no N.SESHASAYEE, J.
