Prayer : Transfer civil miscellaneous petition filed under Section 24 of CPC, seeking to withdraw HMOP.No.54 of 2021 pending on the file of the Sub-Court, Madurantakam and transfer the same to the Family Court, Chengalpattu.

The petitioner / wife seeks transfer of HMOP.No.54 of 2021 on the file of the Sub-Court, Madurantakam to the Family Court, Chengalpattu. Transfer is sought for solely one the ground convenience, since the wife is a resident of Chengalpattu and she is working as a school Teacher. It is also stated she is having custody of a 2 1⁄2 years old male child, who is to be taken care of by her.
2.The learned counsel appearing for the husband would submit that if transfer is made to a Family Court, he will be forced to appear in person for every hearing, which will cause serious inconvenience to him.
3.Considering the convenience of both the parties, I am of the opinion that the proceedings may be transferred to a SubCourt, where appearance of the parties is not required. Hence, HMOP.No.54 of 2021 pending on the file of the Sub-Court, Madurantakam is withdrawn and transferred to the Principal SubCourt, Chengalpattu to be tried and disposed of in accordance with law. of with the above direction. No costs. Consequently, connected miscellaneous petition is closed.
