This petition has been filed to direct the third respondent to register a case based on the complaint given by the petitioner on 06.05.2018.
2. By consent of both sides, this Criminal Original Petition is taken up for final disposal.
3. The learned counsel for the petitioner has submitted that the Assistant Commissioner of Police and the riots have committed offence under Sections 307, 506(ii), 294, 141, 146, 148, 153, 166, 351, 353, 321, 336 of IPC etc apart from the offences for the unauthorized banners including Section 326-1 in the City Municipal Act. He further submitted that in respect of the afore said act, the petitioner has lodged a
complaint before the third respondent on 06.05.2018, but so far no action has been taken.
4. The learned Government Advocate (Crl. Side) has submitted that after receipt of the complaint, C.S.R.No.101 of 2018 was issued and enquiry has been conducted and the same was closed on 09.05.2018.
5. The learned counsel for the petitioner, by way of reply, has submitted that the petitioner was seriously injured and he has been admitted in the hospital, but he was not at all enquired and copy of the C.S.R. was also not issued to the petitioner. He would further submit that without conducting proper enquiry, it appears that the petitioner's complaint has been closed.
6. Recording the submissions made by the learned Government Advocate (Crl. Side), this petition is disposed of with a direction to the third respondent to send a copy of the order, which was passed with regard to the disposal of the petitioner's complaint, by registered post, to the petitioner within a week from the date of the receipt of a copy of this Order. It is open to the petitioner to avail any other remedy which is available under the law.
7. With the above observation, this criminal original petition is disposed of.
