The petitioner apprehends arrest at the hands of the respondent police for the alleged offence punishable under Sections 328 IPC and Section 7 and 20(1) of Cigarette and other Tobacco products Act 2003, Sec.4(1)(a), 4(1-A) of TN Prohibition Act in Crime No.197 of 2022, seeks anticipatory bail.

2. The case of the prosecution is that the petitioner along with other accused were found in possession of 1,639 kgs of banned tobacco products along with 48 pockets of whiskey. Hence, the case.

3. The learned counsel for the petitioner submitted that the petitioner is an innocent person and no way connected with the alleged offence. He would further the petitioner has been falsely implicated in this case and hence he prays to grant anticipatory bail to the petitioner.

4. The learned Additional Public Prosecutor submit that the petitioner along with other accused were found in possession of 1,639 kgs of banned tobacco products along with 48 pockets of whiskey, hence he vehemently opposed to grant anticipatory bail to the petitioner.

5. Considering the quantity of the contraband involved in this case, this Court is not inclined to grant anticipatory bail to the petitioner.
