ORDER

The petitioner who apprehend arrest at the hands of respondent police for the offences under Sections 296(b), 115(2), 118(1) and 351(3) of Bharatiya Nyaya Sanhita (BNS), 2023 in Crime No.349 of 2024 seeks anticipatory bail.

2. The case of the prosecution is that due to previous enmity, the

petitioner along with his brother abused the defacto complainant using unparliamentary words and attacked the defacto complainant's mouth with a wooden log, due to which the defacto complainant sustained injuries. Hence the case.

3. The learned counsel appearing for the petitioner submits that the petitioner is an innocent person and has been falsely implicated in this case. He further submits that custodial interrogation of the petitioner is not required and sought for anticipatory bail to the petitioner.

4. The learned Government Advocate (Crl.Side) reiterated the prosecution case and submitted that the injured has been discharged from hospital and the petitioner has 3 previous cases pending against him and opposed for grant of anticipatory bail to the petitioner.

5. Heard the learned counsel on either side and perused the records.

6. Considering the nature of the offence and also the submission of the learned Government Advocate (Crl.Side) that there are 3 previous cases pending against the petitioner, the custodial interrogation of the petitioner is very much required. Hence, this Court is not inclined to grant anticipatory bail to the petitioner.
