Writ Petition filed under Section 226 of Constitution of India praying for issuance of Writ of Mandamus directing the respondents to consider the representation of the petitioner dated 05.10.2020 and to grant permission/licence to run the bunk shop in the local area of Ambattur, Korattur or any other place in Chennai City under the category of disabled person. O R D E R

This Writ Petition has been filed for the issue of Writ of Mandamus directing the respondents to consider the representation made by the petitioner on 5.10.2020 wherein, the petitioner has sought for license to run a Bunk Shop on the ground that he is a disabled person.

2. Heard Mr.S.Shivakumar, learned counsel for the petitioner and Mr.Arul Dass, learned Govt. Advocate appearing for the respondents 1 to 3 and Mrs.Ramadevi, learned Standing counsel appearing for the 4th respondent.

3. In the considered view of this Court, after coming into of the Street Vendors (Protection of Livelihood and Regulation of Street Vending) Act 2014, the Vending Committee alone has the power to consider the request for putting up any Bunk Shop. The Corporation of Chennai has been divested of that power.

4. In view of the above, this Court is not in a position to grant the relief sought for by the petitioner. However, liberty is granted to the petitioner to make a proper representation before the Street Vending Committee in accordance with the above said enactment and work out his remedy in accordance with law. 5.This Writ Petition is disposed of accordingly.
