The petitioner/A1, who was arrested and remanded to judicial custody on 31.08.2023 in Crime No.672 of 2023, registered for the alleged offences punishable under Section 8(c), 20(b)(ii)(B) and 29(1) of NDPS Act, seeks bail.

2. Learned counsel appearing for the petitioner submitted that the petitioner is an innocent person and he has been falsely implicated in this case, since cases registered under IPC offences are pending against him. He also submitted that the petitioner is no way connected with the alleged offence, whereas, he is suffering incarceration from 31.08.2023. He further submitted that the petitioner is ready to abide by any stringent conditions that may be imposed by this Court. Hence, he prays to grant bail to the petitioner.

Learned Government Advocate (Crl.Side) appearing for the respondent police submitted that the petitioner along with other accused was found to be in illegal possession of 30.300 kgs of ganja, which is a commercial quantity, along with a cash of Rs.4,000/-. drl the accused persons purchased the contraband from Andhra Pradesh and the same was sold to the public and students in Tamilnadu for huge amount for their personal gain. He further submitted that the investigation is still pending and the petitioner has five previous cases, including one NDPS cases, pending against him. However, he opposed for the grant of bail to the petitioner.

4. Considering the grave nature of offence and also considering the facts and circumstances of the case and also taking note of the fact that the twin conditions under Section 37 of the NDPS Act are not satisfied in this case, this Court is not inclined to grant bail to the petitioner.

5. Accordingly, this Criminal Original Petition stands dismissed.
